Aunque la madre incumplió y se llevó unilateralmente a la hija a Venezuela, se le atribuye la custodia.




D.ª Olga y D. Fulgencio estaban divorciados por sentencia de 3 de octubre de 2012. En dicha sentencia se atribuyó a la esposa la custodia de la hija, Zaira, nacida en 2012 con un régimen de visitas a favor del padre y una pensión de alimentos a cargo de este por importe de 180 euros al mes, exigiendo el acuerdo de ambos progenitores o, en su defecto, la autorización judicial, para la salida de la niña al extranjero.

La madre se trasladó a Venezuela y reside en dicho país desde el mes de julio del 2013 y, probablemente, desde diciembre de 2012 en que dejó de estar localizable.

En un posterior procedimiento de modificación, se dictó sentencia el 17 de junio de 2015 y se atribuyó al padre la guarda y custodia de la hija común, con régimen de visitas a favor de la madre y una pensión alimenticia a cargo de esta por importe de 180 euros al mes. En este procedimiento no pudo se localizada la madre.

Cuando posteriormente la madre tuvo conocimiento de la anterior sentencia, interpuso un nuevo procedimiento de modificación de medidas solicitando la atribución de la custodia, petición que fue desestimada por el Juzgado, si bien la Audiencia Provincial le dio la custodia a la madre.

El padre interpuso un recurso de casación para que se le atribuyese la custodia, pero el Tribunal Supremo no atendió su petición al considerar que el interés superior que había que proteger era el de la menor.

Razonó el Alto Tribunal que “Es cierto que la madre ha trasladado su residencia y la de la hija a Venezuela sin sustento en un acuerdo con el padre o en la decisión de uno de ellos consentida expresa o tácitamente por el otro, ni en una decisión judicial previa identificación de los bienes y derechos en conflicto puesto que lo ha hecho de forma unilateral. 

Y, como consecuencia de este cambio el padre interesó, y obtuvo en su momento, la modificación de la medida de custodia, que se argumenta más que en el interés del menor en el hecho del traslado y en el incumplimiento del mandato judicial, del que deduce un ejercicio inadecuado de la guarda de su hija por la madre y la incapacidad de esta para ejercer una guarda responsable de la misma. 

Resolver conforme al interés del menor es lo que ha hecho la Audiencia valorando los únicos datos de que dispone como son el desconocimiento de la niña de la figura del padre, con el que no ha mantenido apenas convivencia, y el hecho de que está escolarizada en Venezuela y cuenta con el apoyo de su familia materna. 

Sin duda podían haberse puesto a disposición del tribunal unos datos más fiables sobre la situación de la niña, así como del padre y de la madre para asumir estos menesteres y resolver un problema, ya de por si complejo dada la situación creada, en función de lo que resulte más favorable para su desarrollo físico, intelectivo e integración social haciendo posible la relación con ambos progenitores pues solo de afectar el cambio de residencia a los intereses de la menor, que son los que deben ser preferentemente tutelados, podría conllevar un cambio de la guarda y custodia. 

Pero los datos son los que son y sin duda justifican en este momento la medida adoptada, sin que ello sirva de instrumento para consolidar la vía de hecho emprendida por la madre, pues siempre estará abierta su revisión al cambio de circunstancias que, en relación a madre e hija, es la misma desde el nacimiento de esta en el año 2012″.

Isabel Fernández de Castillejo y Peetsch estudió Derecho en Alemania (Freiburg, Berlín, Saarbrücken) y Suiza (Lausana). Traductora jurado desde 2003 abrió la firma de traducción "Trans&Law" en el mismo año. Se especializó en inmigración y derecho civil internacional y comenzó a impartir conferencias y seminarios sobre la comparación de leyes, derecho de familia, leyes de inmigración y leyes de bienestar juvenil en la Universidad de Leipzig y en la Universidad de Ciencias Aplicadas de HTWK Leipzig. Ha trabajado como abogada, profesora, formadora, mediadora, tutora ad litem y experta sistemática orientada a la solución. Child Abduction: Committee to hold consultations on India's position in Bengaluru.

The committee deliberating India's position on the Hague Convention on International Child Abduction is likely to hold a second round of consultations in Bengaluru this month. Concentrating till now on cases of parental abduction of NRIs from North India, the committee, has been approached by spouses from South India in the first round of talks that were held in Delhi on September 16 and 17.




"There were a significant number of cases from Andhra Pradesh, Kerala and Maharashtra. Because of the cultural differences the kind of cases will vary differently. There's a need to study these cases as well," said a member of the panel headed by Justice Rajesh Bindal, which was formed in February. In July this year, the panel asked the public for comments.

In the consultation, panel heard cases from both sides. "While the men point at the host country's robust domestic violence laws and say that the child will suffer from the 'parental alienation syndrome', the women say that when a complaint of domestic assault is made, the child protection forces take away the child," said the member. "At this point, we are in a Catch-22 situation."

While over 50 pleas were heard in the panel's first consultation, there are over 95 cases still lodged with the Ministry of External Affairs (MEA). The United States have been pursuing India to sign the Convention to which over 96 countries are signatories. But the plight of women who flee to India from abuse, in most cases, prompted women and child development minister Maneka Gandhi to carry on the consultation.

The panel, which has representation from the Chandigarh Judicial Academy Chandigarh, along with NRI Commission of Punjab, will also study the Civil Aspect of the International Child Abduction Bill, 2016.

El laberinto de Juana Rivas

Juana Rivas a la salida de los jugados de Granada el día 5 de septiembre.

El desgarro de Juana Rivas se hizo público a mitad de la historia. Salió a la luz su pasado de mal trato y reconciliación con su expareja, y su presente como prófuga junto a sus dos hijos pequeños de 7 y 3 años. Todos los estamentos políticos y sociales se posicionaron entonces a su lado y ofrecieron su ayuda. Sin embargo, la madre de Maracena (Granada) que dejó en evidencia los fallos del pacto contra la violencia de género se enfrenta ahora, sola, a un futuro incierto con numerosos frentes judiciales abiertos y sin certezas sobre si podrá continuar con sus hijos. La falta de fondos para afrontar tantas causas le ha llevado incluso a abrir una campaña de crowfunding, denominada 'Ayúdame a seguir luchando', con la que espera recabar mediante donaciones públicas los 60.000 euros que, dice, necesita para pagar a sus abogados, los viajes y los traductores que le ayuden a recuperar a los niños.

El juicio por la custodia de los menores, que se celebrará en Italia el próximo 31 de octubre, es la principal preocupación de Juana, que según señalan desde su defensa jurídica está "muy mal" anímicamente. Desde que su expareja, Francesco Arcuri, se marchara de España con los niños la madre apenas ha podido hablar con ellos. Sus abogados tuvieron incluso que presentar en el país transalpino una denuncia penal por desobediencia a la justicia contra el progenitor por no cumplir la orden de abrir la comunicación entre madre e hijos. "Se está saltando incluso la ley italiana", explican los abogados de Juana, porque no facilita ese contacto: no responde al teléfono cuando ella llama para hablar con los niños, o lo hace pertrechado con excusas varias. "En la práctica, Juana solo habla con sus hijos dos o tres minutos cada cuatro días", reprochan. 

Los abogados pedirán la custodia completa en España para Rivas. Explican que desde el 2009, cuando se produjo la condena de Arcuri por malos tratos, la custodia del hijo que tenían en común le fue concedida a la madre. Pero tras la reconciliación de la pareja y la posterior huida de ella a España, el padre la solicitó en Italia el pasado mes de julio, y al estar fuera la madre los jueces se la concedieron como medida provisional. A esta decisión es precisamente a la que apeló Arcuri para poder volver a su país con los niños, aunque los abogados estudian como recurrirla al entrar en contradicción con la decisión del 2009. El padre, por su parte, ha dejado atrás el ofrecimiento de custodia compartida realizado cuando Juana estaba desaparecida y ahora intentará no solo tener la guardia y custodia de los menores, sino que la madre solo pueda visitarlos en Italia y en presencia del progenitor dado el riesgo de fuga.

Sin noticias de la denuncia

Italia también deberá pronunciare sobre la denuncia de violencia machista que Juana presentó nada más llegar a España, y que tras un archivo inicial se decidió reabrir y que se devolviera al país donde se produjeron los supuestos malos tratos. Un trámite que se dilató casi un año. Aún hoy, según los abogados, "no se ha recibido la denuncia ni se ha incoado expediente" en Italia. El proceso allí podría retrasarse aún otro año más, lamentan los abogados, debido a la lentitud de la justicia italiana, de ahí que hayan intentado sin suerte que fuera tramitado en Granada.

Los juzgados de Granada son precisamente el último frente de Juana. Tienen recurrida la decisión de un juzgado de primera instancia que rechazó que la causa de maltrato fuera vista en España. Sus abogados insisten en que dado que Arcuri tiene representación legal y ha estado aquí durante el mes de agosto, es posible que sea enjuiciado en suelo español sin que tenga una larga residencia.

En esos mismos juzgados se tramita la denuncia penal por sustracción de menores y desobediencia judicial, que presentó el progenitor tras no serle entregados los niños en el punto de encuentro familiar a finales de agosto. En la causa ya han declarado tanto Juana como sus padres y hermanos, además de las responsables del Centro de Atención a la Mujer de Maracena, y han quedado imputados formalmente.

El equipo legal de Rivas sabe que le queda por delante una ardua batalla, pero tiene claro que su defensa pasa por presentar a Juana como "una mujer víctima de violencia machista que debería haber sido defendida por la ley". Si la justicia la hubiera protegido y no le hubiera dado la espalda, insisten, "nada de lo que ocurrió después, habría pasado".

HIGH COURT refuses to return children wrongfully removed from England as they have become well settled in Ireland.

The father of two children who were wrongfully removed from their habitual residence in England in July 2015 has had his application for their return pursuant to The Hague Convention refused in the High Court.

Whilst it was accepted that the mother had engaged in subterfuge and concealment in respect of the removal of the children, and that the actions of the mother in failing to come clean at the outset about her removal of the children to Ireland on a permanent basis contributed to the delay in the case, Justice Reynolds exercised the discretion of the Court in refusing the application as she was satisfied that the children were well settled in Ireland.

Background

The Court heard that a nine-year-old girl and six-year-old boy were brought to Ireland by their mother, S.E.O, in July 2015, in circumstances where the father was not told that the children were being removed from the jurisdiction of England and Wales, and where the mother continuously lied about their living situation.

In proceedings commenced 18 months after the wrongful removal, the father, P.E.O, sought the return of the children to England and Wales pursuant to the provisions of the Convention on the Civil Aspects of International Child Abduction 1980 (The Hague Convention), the provisions of the Child Abduction and Enforcement of Custody Orders Act 1991 and the Matrimonial and parental judgments: jurisdiction, recognition and enforcement, Regulation (EC) No. 2201/2003 (the “Brussels II bis Regulation”).

Well settled

It was contended on behalf of the mother that the children were now well settled within the jurisdiction, and the Court was asked to exercise its discretion in this regard.

Justice Reynolds considered the following authorities: P. v. B. (No. 2) [1999] 4 I.R. 185; P.L. v. E.C. [2009] 1 I.R. 1; and Z.D. v. K.D. [2008] 4 I.R. 751. She also had regard to the decision in Cannon v. Cannon [2004] EWCA Civ 1330 in which “the impact of subterfuge and delay on the settlement of a child were considered in some detail in a useful analysis”.

Accepting that there was clear evidence that the mother engaged in subterfuge or concealment in respect of the removal of the children, and that the actions of the mother in failing to come clean at the outset about her removal of the children to Ireland on a permanent basis contributed to the delay in this case; Justice Reynolds stated that she was also “mindful of the fact that had the applicant acted upon his suspicions in a more timely fashion, that the delay in the commencement of the proceedings would be considerably less”.

A report was also produced for the Court in which a clinical psychologist obtained the views of both children – both children clearly expressed the views that they were much happier here in Ireland and did not want to go back to England. Furthermore, the children were concerned that their father had moved away from the area where they had resided and where they had attended school. Having regard to the principles to be applied in considering the objections of a child, the Court was entitled to take into account their views.

Given the impact of this amount of time on the two young children who are now settled in Ireland, Justice Reynolds was of the view that discretion should be exercised against returning the children to the United Kingdom.

Justice Reynolds explained “…whilst the major objective of the Convention is to secure a swift return to the country of origin, it is clear on the facts of this case that this can no longer be met”.

Conclusions

Having considered all of the facts in the case, Justice Reynolds accepted that there was a wrongful removal of the children to Ireland but refused the relief sought in the exercise of the Court’s discretion in circumstances where the proceedings were commenced more than one year after the wrongful removal and where the children had become “well settled” within the jurisdiction.

Chatham, Ont. mother pleads for return of children husband took to Lebanon

Jolly Bimbachi kissed her two sons goodbye as they set out for a month-long trip to Lebanon with their father, back in 2015.


She gave each of her boys a watch with a note attached, saying: "I love you. We'll be back together in time."

The family vacation turned into a nightmare for Bimbachi shortly after the plane flew out of Pearson Airport in Toronto.

Within days, she got a call from her husband Ali Ahmad — he had no intention of returning with their children.

Omar Ahmad was six years old at the time. His brother, Abdal-Geniy, was four. It's now been two-and-a-half years since Bimbachi, who grew up in Chatham, Ont.and met her husband during a visit to Lebanon, has seen her children.

She is in the midst of a protracted legal battle that has inched along one painstaking day after another. Even though she has since won legal custody of her children from Canadian courts, and has divorced her husband, her fight is not nearly over. International child abduction cases can take years to resolve.

"I'm pleading with the Canadian government and the Lebanese government to come together … to try to solve this," Bimbachi said as tears stream down her face. "Already, my sons sometimes think I don't want to be with them, or that I don't want them, or I don't even love them. I want them to know I would do anything for them."

Attempts to reach Ahmad for comment were unsuccessful.
100 new cases a year

Officials from Global Affairs Canada, which receives about 100 new reports of international child abductions a year, confirmed they are working with Bimbachi, but would not speak to details of her file.

The bulk of Global Affairs cases are reported in Ontario, Quebec and B.C., according to spokesperson Brianne Maxwell, who said getting a child returned to their parents can vary in difficulty depending on the country.

"Each jurisdiction has its own laws with respect to the rights and responsibilities of minors and their parents, and in many cases dual citizenship is also a relevant factor," she wrote in an email to CBC News. "Many countries do not consider parental child abduction to be a criminal offence."


These types of cases can take years to complete, with legal costs often escalating above $100,000, according to James Marks, a Toronto based lawyer who specializes in international child abduction.

"My heart goes out to the mother and the two children, who've been separated from one another for … two years," he said. "That's just lost time for these children, who effectively have been abducted to another country."

Expensive custody battle

Bimbachi nearly collapsed when her then husband told her over the phone he was keeping her boys. The devastated mother frantically went to a filing cabinet where she kept her children's birth certificates and other identification. They were gone.

"I'll probably never see my kids again," Bimbachi recalls thinking at the time. "I didn't know how to go on. I didn't know how to do anything anymore."

She would soon realize her husband cleaned out their joint bank account as well. 

Taking her fight to the courts was a financial disaster for Bimbachi, who teaches part time at St. Clair College and who also works at a craft store in Chatham. She worked with legal aid to gain custody of her two sons in Canada, but that decision carries little weight in Lebanon, where the children remain. 

In March, she was finally able to divorce her husband. She also has another lawyer in Lebanon, who's been working the system overseas, trying to get a date for a custody hearing.

Having her children in Lebanon is another significant challenge. The country is not part of the 1980 Hague Convention, which is a treaty agreed upon by more than 100 countries for the speedy return of a child who is internationally abducted.

Many of the countries have similar parental laws that support having the children live in their home state. In Bimbachi's case, her two boys are Canadian citizens. 

"But … Middle Eastern countries, they don't see it that way, they haven't signed up (to the Hague Convention). It's extremely difficult to apply any pressure on them," Marks said. "Even if she does get custody, the court in Lebanon may not order the children to go back to Ontario."

Bimbachi knows the risks of going to Lebanon to regain custody of her children, but she plans to go there in the coming months, just as soon as she can get a hearing before the courts.

India must sign Hague Convention

WASHINGTON: India not signing the Hague Convention dealing with inter-parental child abduction is a "very serious" issue, the US president's nominee to be the next envoy to India has said.

The Hague Convention on Civil Aspects of International Child Abduction (1980), signed by 96 countries, provides for a mechanism to return a child internationally abducted by a parent from one member country to another.

During the confirmation hearing of Kenneth Juster before the Senate Foreign Relations Committee, Senator Rob Portman from Ohio said that there are 80 known cases of abductions of American kids in India.

Notably, almost all of these cases are a result of marital dispute in which one of the parents have got permission from courts in India to have custody of the children.

In American parlance, these are considered as abductions, mainly because these kids are US citizen by birth.

India is placed second after Mexico when it comes to children being forced to return to the country by a parent in cases of marital discord.
